I don't know what the relevance to prisons is but in Scotland the legislation applies roughly the same as elsewhere, ie smoking is banned in communal areas but not in cells.

As for works vans, that is an area that could do with some common sense, if the van is used only by a single driver then I'd be happy for them to be exempt. It's not a reason to throw out the whole legislation though.

AFAIK some hospitals are banning smoking anywhere within the grounds.

actually the hospital I work at no longer allows patients or anyone else to smoke outside the entrance .If they want to smoke they have to do so outside of the hospital grounds.If Mr X wants to smoke in his van thats up to him...or should he be smoking whilst driving ? Isn't that like using a mobile phone .When I said I see the results of smoking I wasn't implying that those people who choose to smoke shouldn't have treatment like any other person. I do actually see the end results..I am not a nurse..I work in the place where it is too late for treatment of any kind.

Robert,

imagine the scene, you are in a cell with another 2 cons who both smoke, you are therefore in the situation where you ARE being forced to inhale their smoke,are you not?

Ok cells are not a public place but your rights have now been taken away from you.

Vans lorries etc this is as you say open to common sense. However as it stands once the driver leaves England and drives into Scotland he is not allowed to smoke in his van/lorry by Scottish law.
When foreign drivers come into Harwich etc what will happen when they 'light up'?

Some hospitals banning it in their grounds, should it not be one or none? Unless of course it is a private hospital.

In my opinion as a non-smoker the law is an ass.

I don't know the exact rules about prison cells, other than they are exempt. I would imagine there are some non smoking cells, but can't honestly say for certain.

I don't think the law is an ass at all, I think it's a very good law, with the possible exception of the van driver.

we will agree to disagree on this one Robert I think in respect of good/bad law. I thought the days of dictating were behind us but obviously not.

On the cells bit, you don't get to choose who you are 'locked up with' it just happens.

Why are they exempt? that is what I cannot understand, shed any light on it mate?

Most hospitals now have banned smoking anywhere in their grounds. As for the guy in his van, no one said he was driving it was just the fact that he was not allowed to smoke in the van.

There are a few other things I could happily ban but why should I inflict my opinions on others.

As for the PC Brigade being "the last argument of the hard thinking" Robert, you surely even you must agree that they have a lot to answer for with the way things have gone in this country. They have caused more problems than anyone with their stupid yogurt knitting ideas.

I see that a smoking ban comes into force in Spain today. Does it apply to Lanzarote?
